Procedure
for Obtaining a Variance
Application
- After a written denial of a building permit, a property
owner may make application for a variance, using the appropriate form available
at City Hall. The application is made to the Board of Zoning Appeals.
- The application shall be accompanied by a fee of
$25.00 payable to the Town of Dover.
Hearings
- The Board of Zoning Appeals shall hold a hearing to decide
whether a variance from the provisions of the Zoning Ordinance is necessary to
relieve unnecessary hardships depriving the property owner of the reasonable use
of his/her land.
(Property owner
or his/her agent must be present.) -
At its discretion, the Board of Zoning Appeals may hold a Public hearing on the
case.
- The Board of Zoning Appeals shall
consider and decide all applications for variances within thirty (30) days of
such hearing and in accordance with the standards provided in Section 7.080, Variances
of the Dover Zoning Ordinance.
